Prevention of Unfair Means Bill 2024 to be introduced in Parliament today; check details here

Today, on February 5th, 2024, the Government of India (GOI) is scheduled to present a bill in the Lok Sabha aimed at curbing leaks and organised cheating in public exams and entrance tests.
According to the Lok Sabha agenda of the day, Dr. Jitendra Singh is scheduled to propose the Public Examinations (Prevention of Unfair Means) Bill, 2024, aimed at preventing unfair means in public and entrance examinations on Monday, February 05, 2024.
According to PTI, the proposed law will not target students.Instead, it will focus on taking action against organised gangs, mafia elements, and those who engage in malpractices. The law will also hold government officials accountable if they are found to be colluding with such groups.
Over the past few years, leaks of question papers of public examinations led to the cancellation of tests, affecting lakhs of students. The Bill scheduled to be introduced on Monday is aimed at preventing organised gangs and institutions that are involved in unfair means for monetary gains.
According to sources, the Bill proposes a minimum imprisonment of three to five years as punishment. Those who are involved in organized cheating crimes will face imprisonment of five to ten years and a minimum fine of Rs 1 crore.
The proposed law will primarily target organised crime, mafia elements, and government officials found in collusion with them. Students are not included as targets, reported PTI.
Various public examinations in recent times have been marred by paper leak cases, causing candidates to suffer unnecessarily. The Jharkhand Staff Selection Commission (JSSC) has recently postponed the State General Graduate Level Competitive Exam (JSSC CGL) due to leaked questions in the general knowledge section.
Under the anti-paper leak law by the Centre, various government agencies’ examinations and entrance tests like JEE, NEET and CUET may come under scrutiny, including those conducted by UPSC, SSC, and RRB.
In July 2023, the Rajasthan government made some amendments to the Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act – 2022 to prevent frequent cases of paper leak in the state. Other states that have enacted anti-paper leak laws include Uttar Pradesh, Haryana, Assam, and Arunachal Pradesh. While some of these laws pertain to only recruitment examinations, others have covered entrance tests to state educational institutions as well.
